INTEGRASI HUKUM BISNIS DALAM PEMBANGUNAN EKONOMI DI INDONESIA: KAJIAN TEORITIS

Abstract

Economic development is determined not only by the availability of resources, investment, and market activities, but also by the certainty and effectiveness of the legal system governing business activities. Business law plays a strategic role in ensuring legal certainty, protecting business actors and consumers, guaranteeing the enforceability of contracts, and fostering a sound and sustainable investment climate. This study aims to analyze the integration of business law into economic development and to explain the position of business law as an instrument supporting the sustainability of economic activities. The study employs a qualitative approach using a theoretical review or literature study method. Data were obtained from various scientific publications, books, laws and regulations, as well as previous studies relevant to business law and economic development. The analysis was conducted using a descriptive-analytical approach through the identification, interpretation, and synthesis of key concepts related to legal certainty, protection of rights, business governance, investment, business competition, and economic development. The findings indicate that the integration of business law into economic development contributes to establishing legal certainty, reducing risks and transaction costs, protecting the rights and interests of economic actors, increasing investor confidence, strengthening fair business competition, and promoting accountable economic governance. Business law also serves as a regulatory mechanism to ensure that economic growth is not solely oriented toward profit maximization, but also takes into account justice, public protection, and sustainability. Therefore, the integration of business law constitutes an important institutional foundation for achieving inclusive, equitable, competitive, and sustainable economic development.
