ASPEK HUKUM PADA SISTEM PEMBAYARAN DIGITAL MELALUI PLATFORM BELANJA ONLINE

Abstract

The development of digital technology has driven the increasing use of digital payment systems through various online shopping platforms. This study aims to analyze the legal aspects of digital payment systems through online shopping platforms, particularly those related to the validity of electronic transactions, consumer protection, system and personal data security, the responsibilities of the parties involved, and dispute resolution. This study employs a literature review method with a normative juridical approach by examining laws and regulations, books, scientific articles, and various relevant literature sources. The findings indicate that digital payment systems in Indonesia already have a relatively comprehensive legal framework covering electronic transactions, electronic commerce, consumer protection, personal data protection, and the operation of payment systems. However, several challenges remain, particularly in regulatory harmonization, the allocation of responsibilities among the parties, data security, the handling of unauthorized transactions, and the effectiveness of dispute resolution mechanisms. Legal responsibility in digital transactions is, in principle, layered and function-based: the government needs to provide strong regulations and effective supervision, electronic system operators need to ensure system security and transparency, business actors must conduct transactions responsibly, while consumers need to exercise greater caution and improve their understanding of their rights and obligations in digital transactions. This study concludes that the effectiveness of legal protection in digital payments requires synergy among regulators, electronic system operators, business actors, and consumers.
