ANALISIS PENERAPAN CHECKS AND BALANCES DALAM PENYELENGGARAAN PEMERINTAHAN DESA JOTANG KECAMATAN EMPANG (Studi Kasus Pengunduran Diri Kepala Desa Tahun 2026)

Abstract

This study aims to analyze the implementation of checks and balances mechanisms by the Village Consultative Body (BPD) in the administration of Jotang Village, Empang District, Sumbawa Regency, particularly in response to the dynamics that led to the resignation of the Village Head in 2026. Checks and balances are crucial instruments for ensuring accountable and transparent village governance following the enactment of Law Number 6 of 2014 concerning Villages. However, empirical reality in Jotang Village indicates a failure in oversight mechanisms, leading to instability in village governance. This research employs an exploratory case study approach with a qualitative design to uncover the structural and cultural barriers underlying the BPD's inability to effectively intervene in policies or conduct oversight. Data were collected through in-depth interviews, observations, and documentary analysis, and were analyzed inductively to develop analytical generalizations. The results of this study indicate that the implementation of checks and balances between the BPD and the Jotang Village Government in Empang District has not yet functioned optimally. This is evident in the implementation of joint legislative functions, preventive oversight, repressive oversight, the balance of authority, and the channeling of community aspirations, all of which still face various obstacles in practice. The implementation of checks and balances in Jotang Village is influenced by five factors, namely human resource capacity, access to information, the independence of the BPD, community support, and the relationship between the BPD and the Village Head, with the latter being the most dominant factor.
